Ryanair loses case on ash cloud compensation

ECJ ruling states that air carriers have full obligations for their passengers


Eyjafjallajokull volcano eruptionAfter the eruption of the Icelandic volcano, Eyjafjallajokull, Denise McDonagh had a seven-day wait for a Faro-Dublin flight due to the closed airspace over almost all Western Europe. The passenger claimed she spent £968 on a hotel, transport and food.

McDonagh expected a compensation but Ryanair refused this request, her compensation has not yet been paid.

Ryanair had argued the eruption of the volcano was very unusual that normal rules were not applicable.

The ruling stated “extraordinary circumstances” must not release Ryanair and any other air carrier from their obligation toward their passengers.

The court furthermore added that there was no limit on the money and time the air carrier  was expected to invest in compensation.

The ruling of the European Court of Justice states there is no limit in the duty of an airline to look after passengers during any incident, such as volcano eruption and any other “extraordinary circumstances”. The ruling is now binding across the European Union.

ECJ says airlines are fully obliged to cover all costs of passengers who must await their re-routing.
